The short version
- Kin is a notebook and a calculator, not a bank or a broker. We record, compute, and remind. We never hold, move, lend, trade, or guarantee anyone's money.
- Kin Fund: the loan is between you and the other person — never with us. We're not a party to it, and we don't decide who's right if you disagree.
- Kin Income is a self-directed planning tool. It computes what your own plan calls for and gives no investment advice. Every trade is your own decision, placed by you at your own broker.
- You're responsible for your own arrangements, including following any laws that apply to lending, interest, investing, or taxes where you live.
- Free for zero-interest loans. If you charge interest, a modest fee applies.
This summary is here to help, but the full terms below are what actually govern your use of Kin.
1Who we are, and what this covers
Kin is operated by kin.fund (“Kin,” “we,” “us”). These Terms & Conditions are an agreement between you and us, and they apply whenever you use kin.fund or any related app or service (the “Service”). Kin currently offers two products: Kin Fund, a record-keeping and reminder tool for informal loans between people who know each other, and Kin Income, self-directed retirement-withdrawal planning software. The platform sections of these terms apply to both; the product sections apply to the product they name. By creating an account or using the Service, you agree to these terms. If you don't agree, please don't use Kin.
2What Kin is — and what it isn't
Kin is software for keeping careful, honest records of your own money decisions. It records, computes, and reminds — that's the whole job. To be completely clear about what we are not, across every Kin product:
- We are not a bank, lender, money transmitter, payment processor, or escrow service.
- We are not a broker-dealer, investment adviser, or fiduciary, and we never place, modify, or cancel a trade.
- We never take possession of, hold, move, or have access to your money. You move funds entirely outside of Kin, however you already do.
- We are not a party to any loan, agreement, or arrangement you record in Kin. Those exist solely between you and the other people involved.
- We do not provide financial, legal, tax, or investment advice, and nothing in the Service should be treated as such.
- We do not underwrite, verify, guarantee, or insure any loan, repayment, outcome, or person.
3Your account
You need an account to use Kin. You agree to give accurate information, keep your login details secure, and let us know promptly if you suspect unauthorized use. You're responsible for what happens under your account. You must be at least 18 years old (or the age of legal majority where you live) to use Kin.
4Kin Fund — loans and records are between you and the other person
When you create a loan, invite someone, or set terms, you are making an arrangement with another person — not with Kin. The “agreement” recorded in Kin is a convenience for the two of you to capture what you decided. Whether it is legally binding, and on what terms, is between you and the other party and governed by the laws that apply to you. We simply keep the record you both build, including each side's confirmations.
5Kin Fund — the money never moves through us
Every transfer of money happens outside Kin, through whatever method you and the other person choose. We only record that you both say it happened. We have no ability to send, recover, reverse, freeze, or guarantee any payment, and we are not responsible for payments that are late, missing, partial, disputed, or never made.
6Kin Fund — reminders and notifications
Kin sends reminders and notifications related to your loans — for example, when a payment is coming up or when the other person logs something. These are a courtesy to help you stay organized. We don't guarantee that any particular reminder will be delivered, delivered on time, or acted upon, and a missed reminder doesn't change what anyone owes.
7Kin Fund — fees
Using Kin for loans with no interest is free. If a loan involves interest, or you use features we designate as paid, the fees and billing terms will be shown to you before you're charged. We may change our fees, and we'll give reasonable notice before changes affecting you take effect. Fees already paid are non-refundable except where required by law.
8Kin Fund — disputes between members
If you and another person disagree about a loan — whether something was paid, what was agreed, or anything else — that's between the two of you to resolve. Kin is not a mediator, arbitrator, or judge, and we have no obligation to take sides, intervene, or produce records beyond what the Service ordinarily provides. The two-sided confirmation in Kin is designed to reduce disputes, but it is not a legal determination of anything.
9Kin Income — self-directed planning software
An educational tool, not advice. Kin Income is self-directed planning software: a calculator and record-keeper for a withdrawal plan you define. All content, calculations, projections, and figures it produces are for informational and educational purposes only. They are not — and must not be construed as — financial, investment, tax, or legal advice, and they are not a recommendation to buy, sell, or hold any security.
Your plan, your decisions. Every figure Kin Income shows is computed mechanically from inputs you provide and rules you choose: your spending target, your accounts and holdings, your strategy, and your liquidation policy. Kin never selects investments for you, never exercises discretion, and is not your investment adviser, fiduciary, broker, or agent. You are solely responsible for every financial decision you make, including whether, when, what, and how much to buy or sell. We strongly recommend consulting a qualified financial professional who has a fiduciary relationship with you before making significant financial decisions.
No custody, no trading, no credentials. Kin Income never holds your money or assets, never connects to or accepts credentials for your brokerage, and cannot place, modify, or cancel any trade. Executing (or not executing) any transaction is always your own manual act at your own institution.
Estimates, not promises. Figures are estimates built from saved reference prices — never live quotes — and simplified rules (whole shares, no tax-lot optimization). They are hypothetical, may be inaccurate or out of date, and are provided without warranty of any kind. Past or simulated performance never guarantees any outcome; no feature of Kin Income guarantees your money will last.
Assumption of risk; release. You use Kin Income at your own risk. To the maximum extent permitted by law, Kin and its owner are not liable for any losses, damages, taxes, penalties, or other consequences of decisions or actions you take in reliance on information the Service displays, and total liability for any claim is capped at the greater of the amount you paid for the Service in the past 12 months or $100. You agree to indemnify and hold Kin harmless from claims arising out of your use of the Service.
10Your responsibilities
You agree that you are solely responsible for:
- The accuracy of everything you record in Kin.
- Complying with all laws that apply to your arrangements — including, where relevant, lending, interest-rate and usury, consumer-credit, securities, and tax laws. Charging interest in particular may be regulated where you live; that's on you to get right.
- The conduct of your own relationships, the resolution of your own loans, and every investment decision you make.
You agree not to use Kin for anything unlawful, deceptive, abusive, or that infringes someone else's rights, and not to interfere with or attempt to break the Service.
11No warranties
Kin is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, accuracy, and uninterrupted or error-free operation. We don't warrant that the Service will always be available, secure, or free of mistakes.
12Limitation of liability
To the fullest extent permitted by law, Kin and the people behind it will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of money, profits, data, or goodwill, arising out of or related to your use of the Service or any loan or arrangement you record in it — including any money that is not repaid. To the fullest extent permitted by law, we accept no financial liability whatsoever for any claim relating to the Service, and our total aggregate liability to you is zero.
13Indemnification
You agree to indemnify and hold Kin harmless from claims, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your loans or arrangements with others, your financial decisions, your content, or your breach of these terms.
14Suspension and termination
You can stop using Kin and close your account at any time. We may suspend or end your access if you breach these terms, misuse the Service, or where we reasonably need to. Provisions that by their nature should survive — like sections 5, 9, 11, 12, and 13 — will continue to apply after your account ends.
15Changes to these terms
We may update these terms from time to time. If we make material changes, we'll take reasonable steps to let you know, and the “last updated” date above will change. Continuing to use Kin after changes take effect means you accept the updated terms.
16Governing law
These terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules. Any dispute with us will be handled in the courts located there, unless applicable law requires otherwise.
